BREAKING: Dark and Darker Wins Legal Battle

In a landmark ruling, South Korea's Supreme Court has thrown out copyright infringement allegations against the hardcore fantasy PvPvE dungeon-crawler Dark and Darker, clearing the way for developer Ironmace to resume full-scale development.

The decision, delivered today, rejects claims by gaming giant Nexon that the game was built using stolen code and assets from a canceled internal project. Ironmace can now operate without the threat of a shutdown order.

“This is a triumph for independent game creators,” said a company representative. “We always maintained our innocence, and the highest court in the land has affirmed that.”

Background

The legal fight began in 2022 when Nexon filed a lawsuit alleging that Dark and Darker infringed on proprietary materials from its unreleased title, P3. Ironmace, founded by former Nexon employees, denied any wrongdoing, claiming the game was built from scratch.

An initial lower court sided with Nexon, issuing a temporary injunction that halted the game's early access launch and sparked widespread concern among fans. However, that ruling was overturned on appeal, with higher courts finding insufficient evidence of code copying or asset reuse.

Nexon then petitioned the Supreme Court, which today rejected the case without further review, effectively ending the legal threat in South Korea. Legal experts note that the timeline from filing to final decision spanned over two years.

What This Means

For Ironmace, this victory allows them to redirect resources from litigation to game development. “We’ve lost precious time, but now we can push forward with our roadmap,” the company stated. Dark and Darker will continue to receive patches, new dungeons, and gameplay refinements.

For the wider industry, the ruling sets a precedent. “It reinforces that copyright claims must be grounded in clear evidence, not just suspicion,” explained intellectual property attorney Kim Jae-won. “Large publishers cannot use litigation to intimidate smaller studios without solid proof.”

  • Development resumes: Ironmace plans a major content update within the next quarter.
  • Community response: The game's player base celebrated on social media, with many calling the decision a win for indie games.
  • Nexon's options: Nexon could still pursue a civil damages case, but the copyright infringement pillar has been fully dismissed.

The Supreme Court's decision is final and binding in Korea, though litigation could theoretically arise in other jurisdictions where the game is sold. Ironmace has not commented on any international legal exposure.

With the legal cloud lifted, Dark and Darker appears poised for long-term survival. The game launched into early access on Steam in 2023 despite the ongoing case, and has built a loyal following of hardcore dungeon-crawler fans. Ironmace says it will now accelerate its plans for full release.
